These terms are between you and Manas Behera, Im Stöckig 125b, 90765 Fürth, Germany ("we"). Using Nutivio means you accept these terms. If you don't, please don't use the app.
Nutivio lets you scan product barcodes, looks the product up in the Open Food Facts database, shows a health score and short notes for it, tells you whether it fits the food preferences you set (such as allergies or less sugar), and keeps a scan history and shopping list on your phone. You need an internet connection to look up a product you haven't scanned before.
Scores and notes are general information about food products. They are not medical, nutritional or dietary advice and do not take your personal health, allergies or intolerances into account. Do not rely on Nutivio to decide whether a product is safe for you. Always read the ingredients and allergen information on the packaging — especially if you have an allergy or intolerance — and ask a doctor or registered dietitian for personal advice.
Product information comes from Open Food Facts, a free database maintained by volunteers and manufacturers, and is available under the Open Database Licence (ODbL). It can be incomplete, outdated or wrong, and not every product is in it. The Nutivio score is derived from the Nutri-Score that Open Food Facts calculates; where there is no Nutri-Score, Nutivio shows no score. Whether a product "fits your preferences" is worked out from the ingredient and allergen information in that database, so it is only as complete as the database is. If information is missing, Nutivio tells you to check the packaging; a product showing no match to your allergies is not a guarantee that it is safe. We do not guarantee that any information, score or suggestion is correct, complete or suitable for you.
If you add a product that is missing from the database, you confirm that the details and photos you enter are accurate to the best of your knowledge and that you took the photos yourself. If you choose to share it, you license it to the public under the Open Database Licence (data) and Creative Commons Attribution-ShareAlike (photos), through Open Food Facts. Information on the pack, especially allergens, is what counts: always check the pack itself, as a product you or someone else entered may contain mistakes.
You can try Nutivio as a guest with a limited number of scans. To keep scanning, create an account with email, Sign in with Apple or Google. Give accurate details, keep your sign-in details safe, and tell us if you think someone else has accessed your account. You can delete your data or your account at any time under Profile in the app. If you are under 16, you need a parent's or guardian's permission.
Don't misuse Nutivio: no attempts to break, overload or reverse-engineer it, to get around the guest scan limit, or to use it in ways that break the law or the rights of others.
The app, its design, text and software belong to us or our licensors. You may use it for your own, non-commercial purposes under these terms. Nothing here transfers ownership to you.
Nutivio is currently offered free of charge. We may change, pause or end features, or the whole service, for example to improve it or for technical or legal reasons. Where we can, we will tell you in advance.
We are liable without limit for intent and gross negligence, for injury to life, body or health, and where the law requires it (for example under the Product Liability Act). For slight negligence we are liable only for breach of an essential contractual obligation (one on which you can regularly rely), and then limited to the damage typically foreseeable for this kind of service. Any further liability is excluded. Because of section 3, we are not liable for decisions you make about your diet or health based on the scores alone.
You can stop using Nutivio and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms.
We may update these terms, for example when the app changes. We will show the new version in the app and ask you to accept it where the change matters to you. If you keep using the app after a change that does not need your agreement, the new terms apply from then on.
German law applies. If you are a consumer, the mandatory consumer-protection rules of the country where you live stay unaffected. We are not obliged and not willing to take part in dispute resolution before a consumer arbitration board.
